Collaborative Law

 Have you heard from friends and family that going through separation and divorce is ugly, messy and full of conflict? Do you hate the idea of that, and just wish you could sit around a table and talk it out respectfully? That is Collaborative Law. Georgia Simson (formerly Morrissey) is collaboratively trained and Family Centred Law offers collaborative separation services in Shepparton and Healesville.

What makes Collaborative Law different?

  • Both people separating have a genuine desire to work out what is best for their family, even though they won’t be living together anymore.

  • Lawyers and clients sign a contract stating they will not take the matter to court, and they won’t threaten to take the matter to court if negotiations hit a rough patch.

  • Each party has a lawyer who is trained to work collaboratively.

  • A neutral financial consultant is engaged to help both parties understand their finances and how dividing the assets will impact each person.

  • A neutral communcations expert is engaged to help everyone speak respectfully to each other and work towards a good outcome for the each person and the family as a whole.

  • Usually the fees are fixed and both parties pay the same amount, so power imbalances do not arise from differing access to funds.
